What is the background to a Telecommunications Telemedia Privacy Act being passed?

With the TTDSG, the legislator wanted to create a data protection legal framework for the telecommunications and telemedia sector and finally implement EU Directive 2018/1972 for the European Electronic Communications Code in Germany, better known as the Cookie Directive.

Has a completely new law been created?

No, the law has not been created from scratch. The contents of the previous Telecommunications Act and Telemedia Act that affected data protection were transferred to the TTDSG. The two laws were amended in this process and the new TKG also came into force on December 1, 2021.

However, the transfer from the previous laws also brings pitfalls in application, because the scope of application is not the same within the parts of the law.

For data controllers and data protection officers, it should be noted that the legal requirements also apply to non-personal data with immediate effect.

For whom is the TTDSG relevant?

The TTDSG is relevant for everyone who

  • operates a website, whether it is just an informative homepage or an order page
  • operates an app or other services
  • allows employees the private use of the official telephone or e-mail account.
    The last point concerns the secrecy of telecommunications, which since 01.12.2021 is regulated in § 3 TTDSG and no longer in § 88 TKG.

What is also new, however, is that the regulations of the TTDSG also apply to Internet-enabled devices. Manufacturers of smart home applications, connected cars or robots must also observe these new requirements.
