The topic of the whistleblower system has gained in importance with the entry into force of the EU Whistleblower Directive in December 2019. By mid-December 2021, the EU Whistleblower Directive is to be transposed into national law. This will not be the case in Germany, as the previous government was unable to reach a consensus.  In the coalition agreement of November 24, 2021 (page 111), the new government specified a legally secure and practicable implementation of the requirements of the EU Whistleblower Directive.

According to the requirements of the EU Whistleblower Directive (Art. 8 Par. 3), all companies with more than 50 employees or with more than 10 million euros, public institutions and municipalities with 10,000 or more inhabitants must provide secure internal reporting channels. It is important that the identity of the whistleblower is protected by the reporting channel.

A whistleblower system has nothing to do with denunciation, but serves to enable companies to identify risks of unlawful behavior at an early stage and thus protect themselves from sanctions, penalties and also image loss.

The requirement to set up an internal anonymous reporting channel can be met, among other things, by a digital whistleblower solution.

Therefore, aigner business solutions GmbH will offer a digital whistleblower system as a product solution from 2022, which has been specially developed for medium-sized businesses and can be deployed very quickly as a SaaS solution.

The whistleblowers can send their tips very easily via the whistleblowing system. The anonymous tips are received by the case handler, who then verifies the tip and initiates further processing. The processing is documented in the whistleblower system in compliance with the DSGVO.

However, if the company does not offer an internal reporting channel with protection of the whistleblower’s confidentiality, the whistleblower may contact the responsible authorities directly. This is something a company should avoid.
